General Terms & Conditions of Use

A. The Body Shop Online Store Terms and Conditions

Please read this document carefully as it contains the terms and conditions that you agree to be bound by if you continue to use The Body Shop Online Store. The below terms and conditions (“the Conditions”) and the Terms of Use apply to your use of this The Body Shop Online Store and to any purchases you make through The Body Shop Online Store. In the event of any conflict between the Terms of Use and these Conditions, the latter shall prevail. These Conditions and the Terms of Use apply between you and The Body Shop International plc (“The Body Shop”, “we” or “us”), whose registered office is at Watersmead, Littlehampton, West Sussex BN17 6LS, United Kingdom. Please address any complaints, queries or correspondence regarding these Conditions or The Body shop Online Store, to the contacts as listed in our Contact Us page.

C. Purchasing The Body Shop Products

Eligibility to order criteria:

You may only purchase products:

- Available for sale and details of which appear on The Body Shop Online Store; and
- For delivery to England, Wales, Scotland and Northern Ireland.
- For personal use, either by yourself or by your intended recipient(s) of the products. The Body Shop reserves the right to decline any order that it has reasonable cause to believe is for onward sale other than through distribution channels approved by The Body Shop.

Details of the products available for purchase (including their price) are set out on The Body Shop Online Store. The Body Shop takes all reasonable care to ensure that all details, descriptions and prices of products appearing on The Body Shop online store are correct at the time when the relevant information is placed onto The Body Shop online store. Although every effort is made to keep The Body Shop Online Store as up to date as possible, the information appearing at a particular time may not always reflect the position exactly at the moment you place an order.

Ordering Products:

- Once you have selected the products you wish to order, click on the “Checkout” button at the end of the checkout process.
- Once you have clicked on the “Checkout” button we obtain an authorisation from your Credit card company for the amount detailed on the order summary page. We are not taking funds from your card at this stage, although the amount available for you to spend will be reduced by the authorisation. This is a normal process with the banks. If your credit card should not give an authorisation, your order will not be processed further.
- The Body Shop will E-mail you to confirm your product order has been received.
- The Body Shop will E-mail you again to confirm that the products you have ordered are being shipped to you.
- A contract of sale for the products you have ordered is concluded between you and The Body Shop only upon those products being shipped to you.

The Body Shop may refuse or be unable to process your order if:

- The product you ordered is discontinued or no longer available
- Your credit card does not give authorisation for the payment of the purchase price
- You not meeting the eligibility to order criteria set out at the beginning of this Section C.

Should you wish to return or exchange a product bought from The Body Shop Online Store, please follow one of the two below returns procedures:

1. Returns via a parcel carrier

Within 28 days of your receiving the product, please either:

- Visit the My Account area of the The Body Shop Online Store and follow the link to the order. Then select ‘Request RMA’ link; or
- Send an E-mail, with the Subject ‘ Return request- Order No (The order number shown on the front of this delivery note). Detail the items you wish to return.
- Telephone: Call us on 0870 010 1638, please make sure you have this delivery note with you when you call.

You will be issued (by e-mail or over the phone) with an RMA (Return Manufacturer Advice) number. Complete the form which is included with your product, detailing what you are returning, and ensure you write the RMA number into the form. Pack your parcel with care; if you fail to pack the parcel and your goods arrive damaged (as a result of the return trip) we may not be able to process your return. Then send the parcel to us at:

We recommend you use a carrier that offers both traceability and insurance. You should obtain a receipt for the parcel when you send it.

2. Returns via a THE BODY SHOP retail outlet

- Within 28 days of your receiving the product, simply take the delivery note and the product you wish to return or exchange to your local The Body Shop store, and tell the sales assistant you bought the product online.
- The sales assistant will check the goods, and confirm the return with the Care Centre. They will then either refund or exchange the product according with your wishes (if the product you wish to exchange the returned product for has a lower price we will refund you with the difference; if it has a higher price, the sales assistant will require you to settle the difference).
- If you do not present the delivery note, we reserve the right to issue you with a The Body Shop Gift Card/Vouchers to the value of the return, rather than issuing cash.

Please note:

- You will be refunded at the price you paid for the product at the time of your order.
- You will be refunded the product price or exchange the product once the product is received by us at our warehouse or at a The Body Shop retail outlet. A refund of the delivery charge will not be given unless the products returned are incorrect or were delivered in a damaged or faulty state (in which case see paragraph “Incorrect orders and damaged or faulty products” below).
- Once the packaging of a product has been opened or the product is returned by you other than in fully saleable condition, for reasons of hygiene and safety, we are unable to refund or exchange them unless they were delivered to you in a damaged or faulty state (in which case see paragraph “Incorrect orders and damaged or faulty products” below).
- Where you return the product to us via parcel carrier, we will reimburse your carrier costs provided you send back, together with the product, a receipt evidencing those costs.
- If you complete our online returns form but do not then return the products we may arrange for them to be collected from you and you will be charged the costs we incur in making such collection (unless the product delivered to you were incorrect or were delivered in a damaged or faulty state, in which case see paragraph “Incorrect orders and damaged or faulty products” below).

Incorrect orders and damaged or faulty products

If you are returning an incorrect order or a product which was delivered to you in a damaged or faulty state, we would ask you to follow one of the two returns procedures set out above. We will refund you the purchase price, the delivery charge and any parcel carrier costs you incur. We will not charge you any costs we incur in collecting the products from you if you do not deliver them back to us.

F. GENERAL

The Body Shop reserves the right to:

- Modify or withdraw, temporarily or permanently, The Body Shop Online Store (or any part thereof) with or without notice to you; The Body Shop shall not be liable to you or any third party for any such modification or withdrawal; and/or
- Change the Conditions from time to time, and your continued use of The Body Shop Online Store (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using The Body Shop Online Store.
- If The Body shop should change these Conditions, your order will be subject to the Terms and Conditions at the Date and time of you placing your order. Copies of the appropriate T&C are available by email from UKOnline.CareCentre@thebodyshop.com.

If any part of the Conditions is declared unlawful or unenforceable, then that provision shall be deemed deleted from the Conditions and the remaining provisions of the Conditions shall remain in full force and effect. English law applies to these Conditions and any dispute relating to the Conditions shall be settled by the English courts.
